These Terms govern your use of the SecondKoat website and mobile apps (“SecondKoat”, “we”, “us”). By creating an account or using SecondKoat you agree to them. If you don’t agree, please don’t use SecondKoat.
1. What SecondKoat is
SecondKoat is a marketplace where people sell their own pre-loved women’s fashion to other people nearby. Items are sold by independent sellers, not by SecondKoat. Sales are completed by local pickup: the buyer and seller arrange to meet, and the buyer pays through the app.
2. Accounts
You must be at least 18 (or the age of majority where you live), live in Canada or the USA, and give accurate information. One person, one account. Keep your sign-in secure; you’re responsible for activity on your account. To buy or sell you must verify your email address or phone number.
3. Selling
- To receive payments, sellers set up a payout account with our payment processor, Stripe, which verifies identity. Payment processing services for sellers on SecondKoat are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these Terms or continuing to operate as a seller on SecondKoat, you agree to be bound by the Stripe Services Agreement, as it may be modified by Stripe from time to time. As a condition of SecondKoat enabling payment processing services through Stripe, you agree to provide SecondKoat accurate and complete information about you, and you authorize SecondKoat to share it and transaction information related to your use of the payment processing services provided by Stripe.
- List only items you own and have the right to sell, with photos of the actual item and an honest description of brand, size, condition and any flaws.
- Allowed: women’s clothing, jackets and coats, shoes, bags, jewellery and accessories. Makeup, skincare, fragrance and other beauty products only if new, unopened and sealed. Swimwear and lingerie are not accepted.
- Bulk Boxes. You may sell several pre-loved items together as one Bulk Box. A Bulk Box must contain at least 5 items, and the number of items must be stated. Every item must be washed, clean, free of stains and odours, and match the photos and description. Photos must show all items laid out plus close-ups. Beauty products can’t be sold in a Bulk Box. You set the price for the whole box.
- Not allowed: counterfeits or replicas; stolen goods; used or opened beauty and personal-care products; weapons, drugs, alcohol, tobacco or vaping products; recalled or unsafe items; anything illegal, hateful or sexually explicit; and listings that aren’t a real item for sale.
- Every listing is reviewed before it appears. We may reject or remove any listing and may explain why.
- Once a buyer pays, you agree to hand over the item as described. If you can’t, cancel promptly so the buyer is refunded.
4. Buying, pickup, shipping and payment
- You pay the listed price through the app by card, Apple Pay or Google Pay. The item is then held for you and the seller is notified.
- Arrange pickup through in-app messages and meet in a busy public place. Inspect the item before you complete the handoff.
- At pickup you show the seller your 6-digit pickup code (or tap “I picked it up”). Sharing the code or confirming pickup tells us you received the item and releases payment to the seller. Don’t share it before you have the item.
- If the item isn’t picked up within the pickup window shown in the app (currently 7 days), the order is cancelled and you’re refunded in full automatically.
- Either party can cancel an online order before pickup or before it ships; the buyer receives a full refund.
- Shipping. If a seller offers shipping, you can buy online and have the item shipped within the same country. You pay the item price plus the seller’s shipping price in the app. The seller must ship within the window shown in the app (currently 5 days) and add a tracking number, or the order is cancelled and you’re refunded in full. Tap “I received it” when it arrives; if you don’t report a problem within 14 days of shipping, the order completes automatically and the seller is paid. Sellers are responsible for packing items safely and for the shipping cost they charge.
- Paying in person. Some sellers also accept payment in person at a meetup. You can request a meetup time and public place in chat, and the seller can accept or suggest different details. In-person payments are made directly between buyer and seller: SecondKoat doesn’t process them, so they aren’t covered by refunds, Bulk Box protection or pickup codes. Check the item before you pay.
- Apart from in-person payment at a meetup for listings that offer it, don’t pay or ask for payment outside SecondKoat (for example e-transfer or gift cards), and don’t share phone numbers, emails or social handles to move a deal off the app. Off-app payments aren’t protected. Contact details typed in chat are automatically hidden.
5. Fees
Listing and buying are free. When an item sells, SecondKoat keeps a commission from the sale price, currently 9.99%, and the seller receives the rest. The rate that applies is shown in the app when you list and is fixed on each order when it’s paid. We may change the commission for future sales with notice in the app. Sellers receive payouts in the currency of the listing, subject to Stripe’s payout schedule and any currency conversion Stripe applies.
6. Problems and disputes
If something goes wrong with an order, contact us at support@secondkoat.com within 7 days of pickup with your order number. We may review messages and order records and may refund a buyer (including reversing a seller payout) where an item was materially not as described, counterfeit or not handed over. Card chargebacks are handled with Stripe; we may share relevant order and message records to respond.
7. Your content
You keep ownership of photos and text you post. You give SecondKoat a worldwide, non-exclusive, royalty-free licence to host, display, resize and share it to operate and promote SecondKoat while it’s on SecondKoat and for a reasonable time after. You confirm you have the rights to everything you upload.
8. Safety and acceptable use
No fraud, harassment, discrimination, spam, scraping, or attempts to get around our reviews, fees or security. Use the report and block tools. Meet safely: public place, daylight when possible, and tell someone where you’re going. SecondKoat doesn’t attend meetups and isn’t responsible for what happens there.
9. Taxes
Sellers are responsible for any taxes on their sales and income. Stripe may issue tax forms (such as a 1099-K in the USA) where the law requires.
10. Suspension and closing your account
You can delete your account in the app (Account → Profile & account) once no order is in progress. We may suspend or close accounts that break these Terms or put others at risk, and may withhold payouts connected to suspected fraud while we investigate.
- Confirmed reports lead to a ban. If a buyer reports that an item or Bulk Box was dirty, missing items or not as described, and our team confirms the report after reviewing photos, messages and order records, the listing is removed and the seller’s account is suspended. The buyer may be refunded, including by reversing the seller’s payout. Reports are reviewed by a person before any ban.
- Repeatedly trying to take sales or payments outside SecondKoat may lead to a warning and then suspension.
- If you think your account was suspended by mistake, email support@secondkoat.com.
11. Disclaimers and liability
SecondKoat is provided “as is”. We don’t guarantee the quality, safety, authenticity or legality of items, or the truth of listings. To the extent permitted by law, SecondKoat isn’t liable for indirect or consequential losses, and our total liability for any claim is limited to the greater of the fees we earned from the transaction involved or CAD $100. Nothing here limits rights you have under consumer protection laws that can’t be waived.
12. Governing law and changes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there; if you are a consumer you keep the protection of the laws where you live. We’ll post changes here and tell you about significant ones in the app or by email.
